Brookhaven-Chamblee · Probate & Trust

Selling an inherited home in Brookhaven-Chamblee. The old ranch may be worth a second look.

A home first priced under $20,000 can sit on a much different street now.

Selling an inherited home in Brookhaven-Chamblee, then and now

Selling an inherited home in Brookhaven-Chamblee often means holding two numbers that don't seem to belong together. A local history says Longview's first ranches, around 1,150 square feet, were priced from about $17,000 to $19,975 when building began in 1958. That subdivision became part of Huntley Hills, where FMLS shows 20 sales at a $573,000 median from November 1, 2025 through October 31, 2026. A home a parent bought long ago can be the largest thing in an estate, and it can be hard to look at clearly.

You don't have to decide anything today. NRG Nguyen Realty Group handles the home. Your attorney handles the estate. We claim no special title here, and our main probate and trust page explains how the two fit. This page is general information, and it isn't legal or tax advice.

Start wherever you are. Your attorney's name helps, if you have one.

Who may sign

The first call goes to a Georgia probate or estate attorney, who can say who has authority, what the court requires and when a contract can be signed. Where an estate gets opened is a question for that attorney too, and it's worth asking here. Historic Brookhaven's streets run across the Fulton and DeKalb line, and so does Peachtree Place, according to one condo guide. If a trust holds the title, the steps may differ, so bring the trust document.

What a parent's tax bill may no longer tell you

A parent's tax bill may not last. In Chamblee, the city's page offers seniors and disabled residential homeowners a 100% exemption from city property taxes. In Brookhaven, a homesteaded owner pays city tax on a frozen value, and the city's own illustration shows a $500,000 frozen value beside about $1,297,700 unfrozen by 2026. Each depended on someone living there. Ask the DeKalb Tax Commissioner what applies now and what's owed, so the estate isn't budgeting from an old bill. Your CPA or attorney can also speak to how the sale itself is taxed.

A trust also changes what the home can do in the meantime. Brookhaven won't issue a short-term rental permit to a business entity, and its ordinance names personal or family trusts, along with LLCs. An heir who hoped to rent the house by the night while the family decides should know that before spending money on it.

As it stands, or something more

In this area, the buyer may want a house your family never imagined. Brookhaven's 2044 plan says Lynwood Park has seen "teardowns" of older, small homes into much larger houses, and FMLS shows its 13 sales at a $1,100,000 median, built from 2004 on. Drew Valley started in 1954 as brick cottages and ranches of about 1,300 to 1,500 square feet, according to its neighborhood site, and its sales ran from $385,000 to $2,290,000. Briarmoor Manor's oldest streets date to 1954, according to its civic association's history, and its 22 sales had a $667,000 median, at 20.5 days.

So before anyone spends money on carpet, it's worth comparing three things: what the house brings as it stands, what it brings fixed up, and what a builder has paid nearby. We look at each using FMLS and a walk through the home, and if you're out of state, we can walk it by video. These are past results, never a promise for any one home.

Clearing out a house with an old yard

Clearing out can start in the yard, and here the yard may need a permit first. In Brookhaven, any tree 4 inches or greater needs a permit, whatever its condition. Owner-occupied homes pay no fee, while commercial and investment properties pay $25, so ask how the city treats an estate. In Chamblee, a homeowner's first five non-specimen trees a year need no permit on a developed lot, but a specimen tree does, and a dogwood counts at 4 inches.

Chamblee's Public Works Department picks up yard waste on the assigned day, with leaves the day after. Keep the utilities and insurance in place until your attorney says otherwise, and ask your insurer about a vacant home.

Questions

Answers, simplified.

Which probate court handles a Brookhaven or Chamblee home?

Ask a Georgia probate or estate attorney. Some homes near Brookhaven sit in Fulton County rather than DeKalb, and the home's address doesn't necessarily decide where an estate is opened.

Can a family trust get a short-term rental permit in Brookhaven?

No. The city's ordinance says a permit won't be issued to a business entity and names personal or family trusts.

Does my parent's senior exemption stay with the home?

Ask the DeKalb Tax Commissioner or your city. These exemptions depend on an owner who qualifies and lives there, so build your budget from what's confirmed.
