Decatur · Divorce Sale

Selling a home during a divorce in Decatur. Two owners, two tax offices.

Fewer surprises help. Here's where Decatur tends to add them.

Selling a home during a divorce in Decatur means reading the bills first

Selling a home during a divorce in Decatur usually starts with the bills. Someone has been paying them, and now two people need to see them. Inside the city limit there are two bills: one from the City of Decatur, due June 1 and December 20, and one from DeKalb County. The city says it doesn't send bills to mortgage companies, so a lender may be paying from escrow, or may not be. Ask, and put the answer in writing.

NRG Nguyen Realty Group works with both owners or through their attorneys, on the real estate only. Our divorce sale page covers how we work. Your attorney decides what the law asks of you.

The court order a filing brings

The DeKalb County Superior Court's Standing Order Governing All Domestic Cases, in the January 2025 copy on the Clerk's site, stops each party from selling, encumbering or contracting to sell property, jointly or individually held, except in the ordinary course of business, and from disconnecting utilities at the marital residence or changing insurance. Read the current version with your attorney before anyone signs a listing agreement. It also lists one free hour of mediation at the DeKalb County Courts Dispute Resolution Center. A case filed in another county falls under that court's own order.

Things a Decatur home adds to the list

Which side of the line. A Decatur mailing address may be in the city, tax district 92, or unincorporated DeKalb, district 4. That decides how many bills, offices and exemptions you're dividing.

Fees that land in June. Sanitation, $360 since July 2026, and stormwater are billed for the year on the first city installment, so ask the closing attorney how a mid-year sale splits them.

The second bill may look wrong. The city's second installment is figured from the current digest, less what was paid in June, so it can differ widely from the first. Neither owner should read a difference as an error by the other.

Address changes. When one owner moves out, the assessors' office has to hear about it in writing first, and the city after that. Until both have, a bill can reach the wrong person.

Exemptions that need a resident. Each city exemption requires living at the home, and an age or income exemption turns on who qualifies. Ask the finance office and your attorney what a move-out does before it happens.

A club membership. Leafmore-Creek Park Club has a membership fee and annual dues. Lindmoor Woods Swim and Tennis has its own dues. If either is on your list of shared costs, ask the club whose name is on it.

Repairs when neither owner wants to spend

Before a listing, the two of you have to agree on what to fix, and in the city some fixes have their own calendars. A local historic district needs a certificate before a building permit, from a commission that meets on the third Tuesday, with no July meeting. A tree that's dying needs an arborist's report and a permit, with up to 10 business days for processing. A dead one needs a form and photos. We keep the list short, and the attorneys get it in writing.

Pace matters next. From November 1, 2025 through October 31, 2026, FMLS shows a 7-day median in Medlock Park and 6 in Oakhurst, against 19 in Lindmoor Woods and 77 at Tuxworth Springs. Clairmont Place had 82, closing at 91% of original list. If a settlement sets a date, those numbers tell you how much room it leaves. Past results, never a promise for any one home.

The same numbers, at the same time

Each owner hears the same numbers at the same time, in writing. Your home goes to market through the NRG Listing Launch, and what your Decatur home is worth shows the sales we'd start from. If one owner is keeping the home, that's a question for your attorney and a lender first.

Questions

Answers, simplified.

Can I list our Decatur home while the divorce is pending?

Ask your attorney first. DeKalb's standing order restricts selling or contracting to sell property outside the ordinary course of business, and your case may have its own terms.

Who gets the city's tax bill after one of us moves out?

The address on record does. Changes go in writing to the DeKalb County Board of Tax Assessors, and then to the city, so make one owner responsible in writing until they're done.

How fast might our home sell?

It depends on the community. FMLS shows medians from 6 days in Oakhurst to 82 at Clairmont Place from November 2025 through October 2026. No figure promises your home's timing.

Source for FMLS figures on this page: FMLS, pulled November 2, 2026, for sales closed November 1, 2025 through October 31, 2026. A sentence that gives other dates uses those dates.
